4. User Content & Data

You retain all rights to the data, workflows, and content ("User Content") you submit to the Services. By using the Services, you grant XYZGent a worldwide, royalty-free license to use, host, store, reproduce, modify, and display your User Content solely as necessary to provide, improve, and secure the Services.

5. Fees and Payment

Certain features of the Services may require payment of fees. You agree to pay all applicable fees in connection with your use of the Services. We may change our fees at any time by posting a new pricing structure to our website or notifying you by email.

6. Intellectual Property

The Services, including the "XYZGent" name, logo, and all related software, content, and technology, are the exclusive property of XYZGent and its licensors. Except for the limited license granted herein, nothing in these Terms grants you any right, title, or interest in the Services.

7. Termination

We may terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Services will immediately cease.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

IN NO EVENT SHALL XYZGENT, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICES.
